House Passes Bill Eliminating 9.9 Percent Medicare Physician-Payment Cut - 8/6/07

The U.S. House of Representatives voted 225-204 Wednesday to approve H.R. 3162, the Children's Health and Medicare Protection (CHAMP) Act of 2007. This legislation includes provisions that eliminate the scheduled 9.9 percent Medicare physician payment reductions for 2008 and the 5 percent reduction for 2009.

Report Ranks Disability Backlog - 8/6/07

This week the American Association of People with Disabilities (AAPD) released state rankings based on the growing backlog in the federal Social Security Disability Insurance (SSDI) program that revealed hearing offices in Ohio have the 11th worst backlog in the country with more than 36,000 people waiting for a decision.

New Federal Law Requires Tamper-Resistant Prescriptions for Medicaid Patients as of October 1, 2007

As part of a new law taking effect October 1, 2007, federal reimbursement to states for Medicaid patients' prescriptions that are not written on tamper-resistant prescription pads will be denied. The intent is to save the Medicaid program money and prevent patients from illegally obtaining controlled drugs.

The Ohio Tobacco Prevention Foundation (OTPF), an agency that was created to help prevent and control the use of tobacco in Ohio, suffered a major blow when Governor Strickland, with the support of the Ohio General Assembly, took away its funding source to pay for other initiatives in the recently passed biennial budget.

MMO's Medicare Advantage Opt Out Requirement - 7/9/07

Optometrists' Scope of Practice Expansion - 6/15/07

H.B. 149, legislation that significantly expands optometrists' scope of practice, cleared the House Health Committee this past week over the objections of the Ohio State Medical Association and the Ohio Ophthalmological Society. In its current form the bill would allow optometrists to prescribe oral drugs with little or no oversight and perform certain invasive procedures.

In March, when UHC announced that it would start requiring all network providers to refer lab services to a participating lab network, the OSMA received a number of complaints from physicians. The Senate Health Committee is poised to vote on S.B. 120 (Goodman, R-New Albany), a de facto moratorium on physician-owned hospitals Wednesday. If enacted, the legislation would require all hospital facilities in Ohio to have a 24/7 emergency department, with certain exemptions for community hospitals.

Health Net Settlement Claims Update - 4/23/07

Practices (not individual physicians) that filed claims to recover money from the Health Net settlement that is the result of the managed care litigation in Florida are starting to receive letters from the settlement administrator confirming that it received the claim or claims the practice has submitted as part of the settlement, and verifying the amount of the claims. It is anticipated that the actual refund will be mailed in July.

The Centers for Medicare & Medicaid Services (CMS) reported this week that health care spending growth in the United States slowed for the third consecutive year in 2005, increasing 6.9 percent compared to 7.2 percent growth in 2004 and 8.1 percent in 2003.

This week the Ohio Department of Insurance issued the first Ohio Medical Liability Closed Claim report. This report was mandated as part of OSMA-sponsored House Bill 215 from the 125th General Assembly. The law requires medical-malpractice insurers to report data to the Ohio Department of Insurance regarding medical malpractice claims against doctors, dentists, optometrists and chiropractors that close during the year.

After Seven Years, Case Against Insurers Dismissed - 06/26/06

After seven years, the managed care litigation that has been proceeding slowly before U.S. District Judge Federico Moreno in a Miami trial court has ended. On June 19, Judge Moreno threw out all remaining claims against UnitedHealthcare and Coventry Health that alleged the insurers routinely engaged in unfair business practices, including the systematic underpayment of physicians.

On May 11, 2006, the Cuyahoga County Court of Common Pleas formally sanctioned a trial lawyer for wrongly naming an OSMA physician member to a frivolous malpractice claim. The lawyer was ordered to pay $4,500 to Michael Banks, MD, as reimbursement for legal expenses incurred as a result of the frivolous suit.

OSMA Input Pushes Medical Liability Reform Bill Forward - 05/26/06

Following a year of negotiations, research and weeks of committee hearings, OSMA's input was the final item the state Senate Insurance, Commerce & Labor Committee needed to move a new medical arbitration bill forward. Senate Bill 88, sponsored by state Senator Kevin Coughlin (R-Cuyahoga Falls,) would create a seven-county pilot project requiring pre-suit, nonbinding arbitration for medical liability claims.

Following two victories at the Common Pleas Court and Appeals Court levels, physicians scored a major victory in a case before the Ohio Supreme Court. The case, filed by five OSMA physicians, the Academy of Medicine of Cincinnati and the Butler County Medical Society, alleges that Aetna Health, Anthem Blue Cross/ Blue Shield and United Healthcare of Ohio have violated Ohio antitrust law by conspiring with each other to artificially maintain low reimbursement rates for physicians.

How To Get Your National Provider Identifier - 01/09/06

Please remember that providers are required to apply for the new National Provider Identifier (NPI) as required by HIPAA. This new 10-digit NPI eliminates the need for different identification numbers for multiple health plans, including Medicare and Medicaid. All health plans are required by law to implement the new NPI by May 23, 2007; smaller health plans have until May 23, 2008.
