Federal Court Strikes Down Ban on Contributions
Thursday, August 16, 2012A federal appeals court has struck down an Ohio law in the case of Lavin v. Husted that prevented physicians who treat Medicaid recipients from making campaign contributions to candidates running for state Attorney General or county prosecutor.
The OSMA filed an amicus brief in support of the nine physicians who filed the appeal to the 1978 law. The 6th U.S. Circuit Court of Appeals ruled that Ohio’s law imposed far too broad a restriction on doctors’ free speech rights.
